WARRANTY REGISTRATION

LIMITED WARRANTY
Happegear offers a limited lifetime warranty to the original consumer purchaser that Happegear products will be free from defects in workmanship and material under normal consumer use, subject to the exclusions set forth below in Paragraph 4 (“EXCLUSIONS”). This warranty statement sets forth Happegear’s total and exclusive warranty obligation. We will not assume, nor authorize any person to assume for us, any other liability in connection with the sales of our products.
REMEDY
Happegear will repair, replace or refund your original purchase (at Happegear’s option and expense) any Happegear product that fails to operate during the applicable warranty period due to a defect in workmanship or material.
LIMITED TO ORIGINAL CONSUMER BUYER
The warranty on Happegear products is limited to the original consumer purchaser and is not transferable to any subsequent owner.
EXCLUSIONS
Happegear provides no express or implied warranty in relation to protection of car seats, interiors and accessories when using Happegear products. Happegear products are designed as accessories that should be only temporarily used and not permanently or for extended periods of time. Happeseats should be removed from vehicles when not in use, particularly in excessively high temperatures. The Happegear warranty does not cover:
- (i) any product that is misused, abused, altered, damaged by accident, or used outside of normal consumer use as outlined in Happegear’s product literature;
- (ii) any product purchased through unauthorized retailers
HOW TO RECEIVE SERVICE
To obtain warranty service, you must contact our customer service team via our online Contact Us form. If our customer service team determines that further assistance is required, they will give you a Return Material Authorization (“RMA”) number. You must properly package the product, clearly marking the RMA number on the package and include proof of your purchase date with the product. Customer Service will provide return instructions, including return address. We will process your return and then send your repaired or replacement product to you at our expense for product being shipped to locations in North America.
IMPLIED WARRANTIES
THE LIMITED WARRANTY STATED HEREIN IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES. IN NO EVENT SHALL ANY IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, EXTEND BEYOND THE APPLICABLE WARRANTY PERIOD.
EXCLUSIVE REMEDY; LIMITATION OF LIABILITY
The limitations stated herein constitute the entire liability of Happegear and your exclusive remedy for any breach of warranty, whether express or implied. UNDER NO CIRCUMSTANCES SHALL HAPPEGEAR BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OR MALFUNCTION OF ANY HAPPEGEAR PRODUCT, INCLUDING BUT NOT LIMITED TO DAMAGE TO OTHER PROPERTY OR DEVICES, THEFT OR LOSS OF PROPERTY. IN NO EVENT SHALL HAPPEGEAR’S LIABILITY FOR ANY CLAIM, WHETHER ARISING IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY), OR UNDER ANY OTHER THEORY OF LIABILITY, EXCEED THE AMOUNT YOU PAID FOR THE HAPPEGEAR PRODUCT IN QUESTION.
